Terms of Service

1. ACCEPTANCE OF TERMS

Welcome to Request Desk ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, databases, email services, and portal interfaces (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you are prohibited from using the Service and must discontinue use immediately.

2. AGE RESTRICTIONS AND COPPA FIREWALL

The Service is not intended for or directed at children. You must be at least thirteen (13) years of age to access the Service. By using the Service, you represent and warrant that you are at least 13 years old. If we receive actual knowledge that we have collected personal data from a child under 13 without verifiable parental consent, we will immediately delete that information in compliance with the Children's Online Privacy Protection Act (COPPA).

3. ACCOUNT SECURITY

To access certain features of the Service (such as the owner dashboard or coordinator terminal), you must authenticate with a registered email address. You are solely responsible for maintaining the confidentiality of your session tokens and for all activities that occur under your account. You agree to notify us immediately at legal@requestdesk.community of any security breach or unauthorized access to your account.

4. INTELLECTUAL PROPERTY RIGHTS

All software, design templates, neobrutalist components, graphics, code, and interfaces constituting the Service are the exclusive property of Request Desk and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access the Service strictly for tracking and fulfilling nonprofit donations. You may not copy, reverse-engineer, modify, or distribute any part of the Service. You retain all ownership rights to the organization details and request text you upload ("User Content"), but you grant us a royalty-free license to host, store, and process this User Content on our local servers and database backups to provide the Service.

5. PROHIBITED CONDUCT AND ACCEPTABLE USE POLICY

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law.
  • Deploy automated scripts, scrapers, or bots to harvest data or abuse the donation intake form.
  • Introduce viruses, worms, logic bombs, or other malicious code to the database or server.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying host environment.
  • Submit fraudulent tax IDs / EINs or spoof email domains to request unauthorized sponsorships.

6. USER-GENERATED CONTENT AND DMCA SAFE HARBOR

We respect the intellectual property rights of others and comply with the safe harbor provisions of the Digital Millennium Copyright Act ("DMCA") (17 U.S.C. ยง 512). If you believe your copyrighted work has been infringed, you must submit a written notification to our Designated Agent at legal@requestdesk.community containing:

  • A physical or electronic signature of the copyright owner or authorized agent;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing, with details to help locate it;
  • Your contact information (address, telephone number, and email);
  • A statement of good faith belief that the use is unauthorized; and
  • A statement made under penalty of perjury that the information provided is accurate.

7. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REQUEST DESK, ITS CONTRIBUTORS, OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR REVENUES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS THE SERVICE; (B) UNAUTHORIZED ACCESS OR ALTERATION OF YOUR TRANSMISSIONS; OR (C) DATA LOSS WITHIN THE LOCAL DB STORAGE.

9. MANDATORY ARBITRATION AND CLASS ACTION WAIVER

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Dayton, Ohio. YOU AGREE THAT YOU AND REQUEST DESK MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
